Benefits of Mediation in Divorce: What Oklahoma Couples Need to Know
My name’s Palmer Johnson. I’m a family law attorney in Tulsa, Oklahoma, and today I’m going to be talking about mediation. And the question is, do I have to go to mediation to get a divorce? And the answer to that question is, it depends.
If you’re able to reach an agreement about all of the terms of your divorce or paternity action without going to mediation, then you would not have to go. You could submit your agreed order to the court that’s approved by both of the parties, but many times you’re not able to reach an agreement right off the bat.
Understanding the Mediation Requirement
As you prepare your case and go through discovery, moving towards a hearing date, the requirement that you attend mediation is something that you’re going to have to address before you get a hearing date. So the court is going to make you try to solve your problems.
There’s some very positive thinking behind that, and it’s much more workable for the people who are going to be bound by an order to be the people who decided what the terms of that would be. You know what is best for your children.
The Benefits of Mediation
Even if you have fallen out of love or were never in love or very much dislike the father or mother of your child, at the end of the day, you’re going to have to parent with them. And so that’s one thing that you could address in mediation.
Mediation is an excellent tool and it should be taken seriously. It’s a great way to bring a lot of family cases to resolution that the parties are much happier with in the end.
