Understanding Paternity Laws in Oklahoma
Hello, I’m Oklahoma Moms’ Rights Attorney Palmer Johnson. I specialize in family law matters with a particular focus on helping mothers navigate the legal proceedings that affect their families. In today’s video, I want to talk about paternity and establishing paternity for children who are born outside of a marriage.
In the state of Oklahoma, children that are born between two parties that are married is going to automatically establish a presumption of paternity for the husband. For children who are born outside of marriage, paternity needs to be established and that can be done in a few different ways.
Establishing Paternity
If both parties are in agreement at the time of the birth, who the father is and they’re participating in the whole process, the father can be included on the birth certificate. He can sign an acknowledgement of paternity, which is a prescribed form, asserting that he is the father and that he is asserting and preserving his parental rights and responsibilities.
You can have a DNA test if there’s a question as to who the father is and you can establish judicially all of the aspects of a potential paternity matter through a district court where they can establish who the father is, as well as custody, child support, and visitation schedules.
Child Support and Custody Matters
The child support order is going to be kind of a set amount that takes both parties’ incomes and figures out based on percentages and the amount of visitation that they’re exercising, who should be paying what. Custody and visitation are two separate issues aside from the child support that are going to be based on the best interest of the child and the ability of the parties to either co-parent or exercise visitation with their child.
