Today’s question is, what rights do grandparents have in Oklahoma?
So as a general kind of high-level statement, in Oklahoma, the law favors parents’ rights and a parent’s constitutional right to choose how to raise their children. And this includes deciding who they do and do not spend time with. So as a grandparent, you don’t automatically have a right to visit your grandchildren, but there are some specific situations where you could ask the court to allow you visitation.
Seeking Grandparent Visitation
Although this is kind of a nuanced area of the law as a general, kind of broadly speaking, to be able to seek grandparent visitation, you’re going to need to meet the following sort of test or standard. The nuclear family is no longer intact, grandparent visitation is in the child’s best interest, and one or both of the parents are unfit, or denying grandparent visitation will cause the child to suffer harm or potential harm.
