Who Gets Primary Custody in an Oklahoma Divorce?

When we talk about custody, there are two types:

- Legal custody – who makes the major decisions (school, healthcare, religion).

- Physical custody – where the child lives and visitation time.
The term “primary custody” usually refers to legal custody. If one parent is awarded sole legal custody, they have the final say on important decisions. That said, it’s wise to consider the other parent’s input—doing so can reduce conflict and help maintain your custodial rights.
The Court’s Preference: Joint Custody
Now, here’s what the court prefers: joint custody. That’s the legal starting point in Oklahoma. To move away from joint custody, you need a valid reason, like domestic violence, abuse, neglect, abandonment, or substance abuse. Sometimes, both parents agree that one should have sole custody. That works, too.
